Welcome to Botany Books & Booze, a DBA of Botanical Book Bar, LLC. These Terms & Conditions govern your use of our website and your purchase of products from our store. By visiting our site and/or purchasing from us, you agree to be bound by these Terms & Conditions, along with any policies referenced on this website, including our Shipping & Returns Policy and Privacy Policy. Our store is hosted on Wix, which provides the e-commerce platform we use to sell our products and services. 

1. Online Store Use

By using this site, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority and have given consent for any minor dependents to use this site under your supervision.

You may not use our website or products for any illegal or unauthorized purpose, and you may not violate any laws in your jurisdiction through use of this site. You must not transmit viruses, malicious code, or anything destructive through the website.

2. General Conditions

We reserve the right to refuse service to anyone for any reason at any time.

You understand that content you submit through the site, excluding payment information, may be transferred over various networks and adapted to technical requirements. Payment information is encrypted during transmission over networks. 

You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the website, services, or content without our express written permission.

3. Product Information and Availability

We sell live plants, plant-related goods, books, accessories, and botanical lifestyle items. Because many of our products are natural, seasonal, or handmade, slight variation in size, shape, color, variegation, and appearance is normal and expected.

Certain products may be available exclusively online and may have limited quantities. We reserve the right to limit sales by person, household, order, region, or jurisdiction, and to discontinue any product at any time. 

If a plant is listed as shown, you will receive that exact plant. If a plant is listed assorted, variation is normal and expected.

4. Product Photos and Website Accuracy

We do our best to display product descriptions, photographs, and colors as accurately as possible, but we cannot guarantee that your device’s display will reflect true color or detail.

Information on this website is provided for general informational purposes only. While we make every effort to keep content accurate and current, we do not guarantee that all information on the site will always be complete, accurate, or up to date. 

5. Pricing and Order Accuracy

Prices are subject to change without notice.

We reserve the right to modify or discontinue products, services, pricing, promotions, shipping charges, or website content at any time without notice. Occasionally, there may be typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, availability, shipping charges, or transit times. We reserve the right to correct those errors and to change or update information or cancel orders if any information is inaccurate, including after an order has been submitted. 

6. Billing and Account Information

We reserve the right to refuse or cancel any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order, including orders associated with the same customer account, payment method, or billing or shipping address.

You agree to provide current, complete, and accurate purchase and account information for all transactions, and to promptly update your information as needed so we can complete your order and contact you if necessary. 

7. Plant Shipping and Transit Risk

If you are ordering live plants, please review our Shipping & Returns Policy before placing your order. Your current Terms page already directs plant buyers there, and that setup makes sense.

Live plants are perishable goods, and shipping living items always carries some risk. By purchasing live plants, you acknowledge and accept the possibility of transit stress, cosmetic damage, delayed movement, temperature exposure, and shipping-related decline.

We take plant care seriously and securely pack plants using protective materials selected for safe transit. We also treat plants, including rescue plants, for pests and fungus before shipping. That said, plants are living organisms and treatment is not always flawless, so minor imperfections, stress, or occasional issues may still occur.

We are not responsible for damage, delays, or losses caused by courier mishandling, shipping carrier delays, incorrect shipping information provided by the customer, delivery access issues, or extreme weather conditions including heat and freezing temperatures.

Customers are responsible for selecting a shipping method appropriate for the season, destination, and sensitivity of the items purchased. We strongly recommend upgraded shipping for high-value, rare, delicate, or weather-sensitive plants.

8. Rescue, Sale, and Imperfect Plants

Plants sold as rescue, sale, discounted, or otherwise marked as imperfect are offered with known cosmetic wear, prior stress, treatment history, or other non-ideal conditions. These items are sold as is and are final sale, unless otherwise required by law.

9. Wrong Items, Pest Concerns, and Claims

If you believe you received the wrong plant or notice a pest concern upon unboxing, you must contact us promptly and follow any documentation requirements stated in our posted policies.

If a package is lost in transit and insurance applies, customers may be required to file a claim directly with the shipping carrier using the tracking information provided.

Returns, refunds, replacements, and exchanges are subject to our posted Shipping & Returns Policy.

10. Optional Tools and Third-Party Links

We may provide access to third-party tools, services, or links that we neither monitor nor control. These are provided “as is” and “as available” without warranties, representations, or endorsements. We are not liable for your use of third-party tools, websites, products, or services.

Please review the policies and practices of any third-party provider before engaging in transactions with them.

11. User Submissions

If you send us comments, feedback, suggestions, ideas, or other materials, whether requested or unsolicited, you agree that we may use, edit, copy, publish, distribute, and otherwise utilize those materials without restriction or obligation to compensate you.

Your submissions must not violate any law or third-party rights, and must not contain unlawful, abusive, obscene, or malicious material. 

12. Privacy

Your submission of personal information through the site is governed by our Privacy Policy, which is already published on your website. 

13. Prohibited Uses

You may not use the site or its content for any unlawful purpose, to violate laws or intellectual property rights, to harass or discriminate, to submit false or misleading information, to upload malware, to collect personal information of others, to spam, phish, scrape, crawl, or interfere with the site’s security features.

We reserve the right to terminate use of the website or services for violations of these prohibited uses. Your current Terms page already includes a broad prohibited uses section, and it should remain. 

14. Disclaimer of Warranties

We do not guarantee that your use of our website or services will be uninterrupted, timely, secure, or error-free.

All products and services delivered through the site are provided “as is” and “as available,” except as expressly stated by us and to the extent required by law. We do not guarantee that the quality of any product, service, information, or other material purchased or obtained through the website will meet every expectation, or that errors in the service will be corrected. 

15. Limitation of Liability

To the fullest extent permitted by law, Botany, Books, & Booze LLC, its owners, affiliates, employees, contractors, service providers, and licensors shall not be liable for any direct, indirect, incidental, punitive, special, or consequential damages arising from your use of the site, your inability to use the site, any product purchased through the site, shipping delays, plant stress or decline, data loss, or errors or omissions in content.

In jurisdictions that do not allow the exclusion or limitation of incidental or consequential damages, liability shall be limited to the fullest extent permitted by law. 

16. Indemnification

You agree to indemnify, defend, and hold harmless Botany, Books, & Booze LLC and its affiliates, officers, directors, employees, agents, contractors, suppliers, and service providers from any claim or demand, including reasonable attorneys’ fees, arising out of your breach of these Terms & Conditions or your violation of any law or the rights of a third party. 

17. Severability

If any provision of these Terms & Conditions is found to be unlawful, void, or unenforceable, that provision shall nevertheless be enforceable to the fullest extent permitted by law, and the unenforceable portion shall be deemed severed without affecting the validity and enforceability of the remaining provisions.

18. Termination

These Terms & Conditions remain effective unless and until terminated by either you or us. We may terminate this agreement or deny access to our services at any time if, in our sole judgment, you fail to comply with any term or provision of these Terms & Conditions.

19. Entire Agreement

These Terms & Conditions, together with any policies posted on this website, constitute the entire agreement between you and us regarding your use of the site and supersede prior agreements or communications relating to that use.

20. Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of [Your State], without regard to conflict of law principles.
